Annexation Postponed
Based on the feedback received at the public
hearing on Thursday, April 12, 2007 and subsequent discussions with
citizens and elected officials, the Mayor and Town Board have
decided to postpone the request for special legislation to authorize
the annexation. Based on the direction from the Mayor, House
Bill 1133 (Huntersville Annexation) will be deferred and will not be
taken up during the 2007 long session.
According to the Mayor, the Town will
establish an Advisory Board, which will focus on issues raised at
the hearing and other topics related to the proposed annexation.
I strongly encourage those who took the time to attend the hearing
to continue to engage in the dialog and to work with the Town
officials to develop a plan that addresses zoning and timing issues.
On a final note, those who live in the
ETJ should find a certain amount of satisfaction in knowing that
your voice was heard and you made a difference. You built a
good case, you captured the town official's attention, and you have
laid the groundwork for creating a win-win for the property owners
in the ETJ and the Town.
Update: April 16, 2007
The Town of Huntersville hosted a public
hearing on Thursday, April 12, 2007. The hearing was attended
by more than 100 residents. Every who spoke indicated they
were against the annexation. One speaker asked for a show of
hands from the audience for people who were against the annexation
and nearly everyone raised their hand. When asked who was for
the annexation, no one raised their hand.
With the public notices and hearings
completed, the Town of Huntersville will take up the question as to
whether to request that Representatives Tillis and Saunders consider
moving forward with the local legislation. The Town of
Huntersville will likely take up this matter at the regularly
scheduled meeting on April 16, 2007. If the Town votes to
request the special legislation, the local representatives must
decide whether to move forward. If you have an opinion about

The Town of Huntersville has requested
special legislation to authorize the annexation of the areas east of
Highway 115 that are within the Town's "sphere of influence."
In the picture below (CLICK this link),
the yellow area to the right is the target area for the annexation.
There is a filing deadline of March 28th
to file bills that are "local" in scope, so I must file the bill in
order for it to be considered in this 2007 session. As the bill
sponsor and the Representative whose district covers the majority of
the target area, I have the authority remove the bill from
consideration if there are any concerns or if there is significant citizen
opposition. The bill filing does not suggest that the measure
will move forward. I
simply want to give the Town officials the opportunity to secure
public support and, unless I file by the deadline, it would postpone consideration
until 2009.
As a condition for filing the bill, I
have asked the town to complete due diligence, including public
notice through the print media, a mailing to every affected
household, and a public hearing on April 12th
